Notice of Public Meeting Concerning an Official Plan Amendment to Address Minimum Distance Separation (MDS) Formulae Application No. OPA-02-17 Township of Cavan Monaghan Take Notice that the Township of Cavan Monaghan is proposing a housekeeping Amendment to the Official Plan for the Township of Cavan Monaghan. The Amendment is required to introduce a new Section to allow the Township to exercise the options available to municipalities under Implementation Guidelines #7, #9, #35 and #38 of The Minimum Distance Separation (MDS) Formulae and Guidelines, Publication 853, effective March 1, 2017. The Amendment will apply to the entire Township. Take Notice that the Council of the Township of Cavan Monaghan will hold a public meeting on Monday, June 19, 2017 at 1:00 p.m. in the Council Chambers of the Township of Cavan Monaghan Municipal Office at 988 County Road 10, Millbrook ON to consider the proposed Official Plan Amendment under Section 17 of the Planning Act, R.S.O., 1990 as amended. Official Plan Amendment The purpose of Amendment No. 2 to the Township of Cavan Monaghan Official Plan is to add a new policy to Section 3, General Development Policies, namely Section 3.27, to clarify the applicability of MDS Formulae under various Planning Act applications and to allow the Township to exercise the options available to municipalities under Implementation Guidelines #7, #9, #35 and #38. The addition of this new Section will assist with incorporating appropriate MDS policies in the Township’s Comprehensive Zoning By-law through the Zoning By-law Update Project currently underway. Specifically, the OPA proposes to exempt lands designated as Hamlet or Millbrook Urban Settlement Area on Schedules “A” and “A-1” of the Official Plan from the applicability of (MDS I) as it is generally understood that the long-term use of these lands is intended to be for non-agricultural purposes. In addition to the new policy in Section 3.27, a number of other sections will be updated to acknowledge the applicability of Section 3.27. Effective March 1, 2017, the Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) released new Minimum Distance Separation (MDS) Formulae as defined in the Provincial Policy Statement, 2014 (PPS). The 2017 MDS Formulae replaces all earlier versions of the MDS Formulae and Implementation Guidelines. The intent of MDS Formulae is to prevent land use conflicts and minimize nuisance complaints from odour. Sections 3, 4 and 5 of the MDS Formulae form the basis for MDS provisions that must be incorporated into local land use planning documents to achieve consistency with the PPS and provincial plans. A Key Map is not provided as the policy applies to the entire Township of Cavan Monaghan. Any person may attend the public meeting and/or make a verbal or written representation either in support of or in opposition to the proposed Official Plan Amendment. If you are unable to attend the meeting, written submissions may be submitted and should include a request for further notice, if desired. Pursuant to Section 17 of the Planning Act, R.S.O., 1990, as amended, you are hereby requested to submit your comments to the Clerk no later than 12 p.m. (noon) on the 19th day of June, 2017. If you wish to be notified of the adoption of the proposed Official Plan Amendment or of the refusal of a request to amend the Official Plan, you must make a written request to the Township of Cavan Monaghan at 988 County Road 10, Millbrook, ON L0A 1GO. If a person or public body does not make oral submissions at a public meeting or make written submissions to the Council of the Township of Cavan Monaghan before the Official Plan Amendment is adopted, the person or public body is not entitled to appeal the decisions of the Council of the Township of Cavan Monaghan to the Ontario Municipal Board. If a person or public body does not make oral submissions at a public meeting or make written submissions to the Council of the Township of Cavan Monaghan before the Official Plan Amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to add the person or public body as a party. Additional information about the proposed Official Plan Amendment is available for inspection by the public at the Municipal Office from Monday to Friday during regular office hours (8:30 a.m. to 4:30 p.m.).
